The Bombay High Court on Tuesday, 27 October, kept in abeyance until 2 November a notice from the Foreigners Regional Registration Office (FRRO), Mumbai, asking actor Imran Khan to leave India by 28 October, PTI reported. A bench of Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna recorded that “the impugned notice shall stay in abeyance until then” after Additional Solicitor General Anil Singh gave an oral assurance that nothing would happen in the meantime. Solicitor General Tushar Mehta, appearing for the FRRO, had sought time.

No Exit Deadline for Now

The order means Khan does not have to leave India on 28 October while his petition is pending. According to PTI, the FRRO invoked Sections 7(2)(c) and 29 of the Immigration and Foreigners Act, which cover restrictions on a foreigner’s presence and removal, and warned that deportation proceedings could start if he did not leave. PTI described Khan as a US citizen and reported that he also received a show-cause notice asking why his Overseas Citizen of India status should not be revoked.

A Protest on 10 October and a Petition on 17 October

PTI reported that Khan was briefly detained on 10 October at a protest at August Kranti Maidan in Mumbai, held in support of Delhi demonstrations by the Cockroach Janta Party demanding the resignation of Chief Election Commissioner Gyanesh Kumar over the SIR issue. Khan moved the High Court on 17 October. His petition calls the notice “illegal, arbitrary, perverse and drastic” and says he did not take part in any gathering and has no link to the organisers. He wants the notice quashed and a bar on coercive steps. PTI noted that the petition refers to a notice issued by the Mumbai police, while the departure notice was issued by the FRRO. Plea to Be Heard on Monday, 2 November

The High Court will hear Khan’s challenge to the notice on Monday, 2 November. The FRRO’s response to the petition has not been reported.
